1. Introduction

Welcome to Shift Rider Manager ("we," "our," or "the Service"). By accessing or using our shift management platform, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our Service.

Shift Rider Manager is a dedicated shift management platform designed exclusively for agencies to manage their driver assignments, customer bookings, and shift operations. We are committed to providing a secure, reliable service focused solely on shift management.

2. Definitions

"Agency" refers to the organization or business entity that subscribes to our Service to manage their shift operations.

"Driver" refers to the individual workers whose shifts are managed through the platform by an Agency.

"Customer" refers to the end clients booking shifts through an Agency.

"User" refers to any person accessing the Service, including Agency staff, Drivers, and Customers.

3. Account Registration and Responsibilities

3.1 Agency Accounts

  • Agencies must provide accurate and complete information during registration
  • Agency administrators are responsible for managing user access within their account
  • Agencies must maintain the security of their account credentials
  • You are responsible for all activities that occur under your account

3.2 Driver Accounts

  • Driver accounts are created and managed by their respective Agency
  • Drivers must use the platform responsibly and update shift status accurately
  • Driver access is provided solely for shift management purposes

4. Service Description

Shift Rider Manager provides the following core functionalities:

  • Shift scheduling and assignment management
  • Driver and customer management
  • Real-time shift status tracking
  • Automated invoicing and billing
  • Location tracking for active shifts (GPS)
  • Rate chart configuration and shift charge calculation
  • Reporting and analytics for business operations

We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice to users.

5. Data Usage and Privacy Commitment

Our Privacy Commitment

We explicitly state that Shift Rider Manager does NOT use, share, sell, or repurpose driver data or agency data for any other businesses or third-party commercial purposes. Your data is used exclusively for providing and improving the shift management services you have subscribed to.

5.1 All data collected (including driver information, shift details, location data, and customer information) is used solely for the purpose of operating the shift management platform.

5.2 We do not sell, rent, or trade your data to third parties for their marketing or business purposes.

5.3 Data is stored securely and accessed only by authorized personnel for support and maintenance purposes.

6. User Obligations and Prohibited Activities

You agree NOT to:

  • Violate any applicable laws or regulations
  • Share your account credentials with unauthorized individuals
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use the Service to transmit malicious code, viruses, or harmful content
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Service for any fraudulent or illegal activity
  • Interfere with or disrupt the integrity or performance of the Service
  • Scrape or collect data from the Service using automated means without permission

7. Subscription and Payment

7.1 Subscription Plans: Agencies subscribe to the Service on a recurring basis as per the selected plan.

7.2 Payment Terms: Payment is due according to the billing cycle selected during subscription.

7.3 Trial Period: We may offer a trial period for new agencies. The trial terms will be communicated during registration.

7.4 Cancellation: Agencies may cancel their subscription at any time. Cancellation will be effective at the end of the current billing period.

7.5 Refunds: Refunds are provided on a case-by-case basis and are not guaranteed for partially used billing periods.

7.6 Deactivation: Failure to pay subscription fees may result in account deactivation and loss of access to the Service.

8. Location Tracking and GPS Data

8.1 The Service uses GPS location tracking during active shifts to record driver locations at key status updates (Reached, Running, Complete).

8.2 Location data is collected only when drivers update shift status through the mobile interface.

8.3 Location information is visible only to the respective Agency managing the shift.

8.4 Drivers acknowledge and consent to location tracking as a necessary feature of the shift management process.

8.5 Location data is NOT shared with third parties or used for any purpose outside of shift tracking and verification.

9. Intellectual Property Rights

9.1 All content, features, and functionality of the Service (including but not limited to software, text, graphics, logos, and design) are owned by Shift Rider Manager and are protected by copyright, trademark, and other intellectual property laws.

9.2 You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.

9.3 You retain ownership of all data you input into the Service (shift records, customer data, driver information).

10. Limitation of Liability

10.1 The Service is provided "as is" without warranties of any kind, either express or implied.

10.2 We do not guarantee uninterrupted, error-free, or completely secure operation of the Service.

10.3 We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10.4 Our total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10.5 We are not responsible for disputes between Agencies and Drivers, or between Agencies and Customers.

11. Data Backup and Export

11.1 While we maintain regular backups of our systems, you are responsible for maintaining your own copies of critical data.

11.2 You may request a data export of your information at any time.

11.3 Upon account termination, we retain data for 90 days before permanent deletion, unless required by law to retain longer.

12. Termination

12.1 You may terminate your account at any time by contacting our support team.

12.2 We may suspend or terminate your access to the Service if you violate these Terms or engage in prohibited activities.

12.3 Upon termination, your right to use the Service will immediately cease.

12.4 Provisions that by their nature should survive termination will remain in effect (including intellectual property, limitation of liability, and governing law).

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the platform. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

14.1 These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law provisions.
